1ª.- Identificación de la empresa.

La empresa de turismo activo Tracks and Pedals, es titularidad de Domingo Rus Arce, con NIF n.º 73916388T, y domicilio en C/ Soroller, 5, 46780 - Oliva (Valencia).

Además, la empresa dispone de una web con información sobre la empresa y sus actividades o viajes en www.tracksandpedals.es. Asimismo, el correo principal de contacto con Tracks and Pedals es info@tracksandpedals.es.

2ª.- Gestión de riesgos.

Las actividades que ofrece Tracks and Pedals implican un peligro intrínseco e incluso propiciado, que el/la participante asume y acepta. La responsabilidad de Tracks and Pedals, teniendo en cuenta lo anterior, no es programar y realizar actividades exentas de peligros o “seguras”, sino gestionar el riesgo para que esté dentro de unos límites y que la práctica de esa actividad no conlleve la causación de daños a la integridad física o la vida de los/las participantes.

Para ello, Tracks and Pedals se compromete a que:
El personal técnico esté capacitado para la actividad o viaje que se vaya a realizar.
Las actividades o viajes estén cubiertas por seguros de responsabilidad civil y de accidentes.
Las actividades o viajes estén adecuadamente planificadas, especialmente en cuanto a la gestión de riesgos y adversidades.

3ª.- Información sobre las actividades.

Tracks and Pedals se compromete, además de informar de la clase de actividad, su lugar de realización, el material/equipo necesario, y su duración, a especificar con escalas o con descripciones la dificultad técnica y física que implica cada actividad. Tracks and Pedals podrá establecer requisitos o condiciones personales de acceso a las actividades o viajes, únicamente cuando sea necesario para preservar las condiciones mínimas de seguridad de la actividad o para su óptimo aprovechamiento o disfrute por el/la participante y por el resto del grupo. El/la participante se informará debidamente de la actividad a realizar, para tener la convicción de que dicha actividad es la que en realidad desea, y es la adecuada a sus características personales.

En cuanto al material y equipo necesario, en la ficha de la actividad se indicará el material y equipo que aporta Tracks and Pedals y que estará incluido en el precio, así como el material y equipo que deberá aportar el/la participante.

Tracks and Pedals se reserva el derecho a modificar la oferta formativa presentada en el website (modificaciones sobre actividades, fechas, plazos, localizaciones, precios, ofertas y otras condiciones comerciales y de servicio) en cualquier momento. Tracks and Pedals hace todos los esfuerzos dentro de sus medios para ofrecer la información contenida en el website de forma veraz y sin errores tipográficos. En el caso de que en algún momento se produjera algún error de este tipo, ajeno en todo momento a la voluntad de Tracks and Pedals, se procedería inmediatamente a su corrección. De existir un error tipográfico en alguno de los precios mostrados y algún cliente hubiera tomado una decisión de compra basada en dicho error, Tracks and Pedals le comunicará al cliente dicho error y el cliente tendrá derecho a anular su inscripción sin ningún coste por su parte.

Los contenidos del sitio web www.tracksandpedals.es podrían, en ocasiones, mostrar información provisional sobre algunas actividades o viajes. En el caso de que la información facilitada no correspondiera a las características definitivas de la formación, el cliente tendrá derecho a anular su inscripción sin ningún coste por su parte.

4ª.- Grupos mínimos y ratios.

Las actividades o viajes que organiza Tracks and Pedals han de contar con la participación de un número mínimo de personas, el cual se fija por cuestiones de seguridad y/o por razones de rentabilidad económica.

Asimismo, Tracks and Pedals también fija unos límites máximos de participantes por guía o técnico, para cada actividad o viaje, a fin de garantizar unas condiciones mínimas de seguridad y de aprovechamiento/disfrute de la actividad o viaje en cuestión por todo el grupo, que si fuera excesivamente numeroso no se podrían garantizar.

5ª.- Condiciones psico-físicas.

El/la participante ha de informar a Tracks and Pedals o, al menos, a los guías, técnicos o monitores/as sobre:
Problemas de salud (alergias o enfermedades).
Lesiones.
Medicación de sustancias que puedan alterar sus aptitudes habituales.
Cualquier incidencia ocurrida durante el desplazamiento a la misma (físicas, psíquicas, material, etc.) aunque puedan parecer insignificantes, como mareos por el viaje, debilidad por un mal desayuno, etc.
El/la participante se compromete a no estar influenciado por los efectos de sustancias alcohólicas, psicotrópicas, excitantes o alucinógenas, en la fecha en la que se desarrollen las actividades.

6ª.- Precios.

Los precios son en euros y por persona, e incluyen los servicios de los guías, técnicos o monitores/as de Tracks and Pedals y el IVA vigente. Salvo que expresamente se indique lo contrario, la contratación de los servicios externos (hoteles, refugios, albergues, comidas, transporte, teleférico, etc.), serán a cargo del/la participante.

7ª.- Inscripción en actividades.

La inscripción en las actividades de Tracks and Pedals tiene que realizarse documentalmente. La ficha de inscripción debe ser rellenada por el/la participante y enviada o presentada a Tracks and Pedals principalmente por medio de la web www.tracksandpedals.es.

La inscripción no se entenderá formalizada y efectiva hasta que se realice el pago del precio/reserva de la actividad o viaje contratado, según el procedimiento fijado en la cláusula siguiente.

8ª.- Forma de pago.

El 100% de la actividad o viaje ha de ser abonado a Tracks and Pedals antes de las 48 horas de su comienzo, y, salvo que las condiciones particulares de la actividad o viaje especifiquen otros plazos. El 30% del precio final se pagará por adelantado en el momento de la reserva.

El pago del precio de las actividades o viajes organizados por Tracks and Pedals debe hacerse por alguno de los siguientes medios:
En efectivo en la oficina de Tracks and Pedals.
Con tarjeta bancaria de crédito o débito.
Transferencia bancaria o ingreso en cuenta en la siguiente cuenta bancaria (Banco Santander):

En el caso de que se realice el pago mediante transferencia bancaria o ingreso en cuenta, el/la participante, antes del comienzo de la actividad, ha de enviar por cualquier medio de comunicación o entregar a Tracks and Pedals o, en sus caso, a los guías, técnicos o monitores/as, el justificante de dicho ingreso o transferencia.

El pago se realizará siempre en euros.

En determinados casos y para prevenir posibles fraudes, Tracks and Pedals se reserva la posibilidad de elegir la forma de pago concreta, especialmente en el caso de que no se acredite fehacientemente la identidad del titular del medio de pago.

9ª.- Cancelaciones.

A la hora de anular una actividad o viaje, el cliente debe tener en cuenta que existen gastos asumidos por la agencia por pagos a proveedores que en la mayoría de los casos pueden ser no reembolsables, tales como pagos de determinados alojamientos, excursiones o emisión de billetes aéreos. En estos casos los referidos gastos deben ser asumidos en su totalidad por el viajero.

En caso de desistimiento, se aplicarán unos porcentajes sobre el importe total del viaje dependiendo del momento en el que se produzca y se comunique a la agencia:

a) De dos meses a 15 días antes de la salida: 5%

b) De 14 a 3 días antes de la salida: 10%

c) En las 48 horas previas a la salida: 25%

d) De no presentarse el cliente a la salida, en el punto y momento acordado, o sin la documentación necesaria, el cliente está obligado al pago del importe total del viaje o actividad, abonando, en su caso, las cantidades pendientes.

El cliente del viaje combinado podrá ceder su reserva a una tercera persona, solicitándolo por escrito con un mínimo de 15 días de antelación a la fecha de inicio del viaje, salvo que las partes pacten un plazo menor en el contrato. El cesionario tendrá que reunir los mismos requisitos que tenía el cedente, exigidos con carácter general para el viaje combinado, y ambos responderán solidariamente ante la agencia de viajes del pago, del precio del viaje y de los gastos adicionales justificados de la cesión.

En aquellos casos de cesión de plaza en los que se haya emitido el billete aéreo, notificado al cliente, la agencia no estará obligada a hacer frente a los costes de cambio de titular de billete o una nueva compra de servicios aéreos. Las partes solidarias de la cesión, deberán hacer frente a la emisión de los nuevos billetes aéreos.

Modificación de reserva: Cualquier cambio y/o modificación solicitada por los clientes una vez iniciado el trámite de la reserva (conforme o no) incurrirá en unos gastos de gestión de 30 euros a 55 euros, según destino.

Tracks and Pedals tiene el derecho de anular el viaje o actividad, en casos de fuerza mayor. Se entenderá por fuerza mayor aquellas circunstancias ajenas a quien las invoca, anormales e imprevisibles cuyas consecuencias no habrían podido evitarse, a pesar de haber actuado con la diligencia debida.

La agencia podrá cancelar la salida de un viaje por causas de fuerza mayor, el viajero tendrá derecho al reembolso de las cantidades abonadas, excepto los gastos de gestión y los gastos que hubieran sido comunicados como no reembolsables ( pagos de determinados alojamientos, excursiones o emisión de billetes aéreos, etc.)

En ningún caso, la cancelación de una actividad o del viaje implicará la devolución de una suma superior al coste de la propia actividad o del viaje, ni generará obligación de indemnizar por parte del organizador.

En caso de imposibilidad de continuar el viaje por causas de fuerza mayor, el Organizador asumirá el coste del alojamiento que sea necesario, de ser posible de categoría equivalente, por un periodo no superior a tres noches por viajero. El viajero no tendrá derecho al reembolso, ni indemnización alguna.

10ª.- Transporte.

Salvo indicación contraria en el programa, será de cargo y cuenta del/la participante los costes y responsabilidad del transporte hasta el punto de encuentro pactado con el personal de Tracks and Pedals. El/la participante llegará a las actividades con antelación suficiente para solventar cualquier imprevisto o necesidad. Del mismo modo, los guías, técnicos o monitores/as de Tracks and Pedals asumen su obligación de ser puntuales en los horarios convenidos. La acumulación de pequeños retrasos incide directa y muy negativamente en la seguridad, armonía del grupo y buen desarrollo de la actividad.

11ª.- Inicio de actividad.

La sesión teórica o explicativa previa a la actividad, se considera INICIO de los servicios.

12ª.- Normas de seguridad.

El/la participante prestará y mantendrá, durante todo el desarrollo de la actividad, la debida atención a las instrucciones que se puedan impartir por parte de la organización y tendrá una atención muy especial a los guías, técnicos o monitores/as responsables de la actividad, siguiendo todas las indicaciones de actuación y/o seguridad que puedan proporcionarle.

Sin conocimiento y expresa autorización de los/las responsables, el/la participante no se situará en lugares potencialmente peligrosos como grandes desniveles, precipicios, suelos inestables, corrientes de agua turbulenta, simas, placas de hielo, zonas de hielo, desprendimientos, avalanchas, etc.

13ª.- Uso del equipo o material de seguridad.

El/la participante mantendrá en todo momento bien puesto todo el equipamiento específico de la actividad, intensificando su atención y cuidados con el equipamiento de protección y seguridad, tanto individual como colectivo, conservará el material asignado para las actividades, y comunicará instantáneamente si se produce algún deterioro o pérdida durante la realización de dichas actividades. Los equipos para el desarrollo de las actividades no son instrumentos de juego, y su buena utilización hará que la actividad sea mucho más agradable y segura.

Al finalizar la actividad, el/la participante entregará todo el material asignado a los/las responsables de la misma. En caso de pérdida o rotura del material prestado o alquilado por Tracks and Pedals que sea debida a la negligencia del/la participante, éste/a podrá ser obligado/a a abonar su valor o a reponerlo.

14ª.- Normas medioambientales.

El/la participante respetará profundamente el medio natural donde se desarrolle la actividad, intensificando este cuidado en las zonas de espacios naturales protegidos, donde se cuidará además de cumplir la normativa de dichos espacios naturales protegidos. En el entorno natural no deben quedar residuos ni basuras. Respetará igualmente a otros grupos o personas que estén en las zonas donde se realicen las actividades.

15ª.- Deber de colaboración.

Las actividades son en equipo, por lo que el/la participante tendrá que colaborar y ayudar a los/las demás participantes y responsables de la actividad cuando así sea requerido. El/la participante no asumirá, en ningún caso, las labores o responsabilidades de los guías, técnicos o monitores/as, y evitará comportamientos prepotentes o exhibicionistas, que suelen degenerar en mal ambiente en el grupo.

16ª.- Modificaciones en la programación.

Si antes de la salida del viaje o del inicio de la actividad, Tracks and Pedals se viera obligada a alterar de manera significativa alguno de los elementos esenciales del viaje o actividad, deberá notificarlo al cliente inmediatamente, directamente, o bien a través de la Agencia Detallista. En este caso, el cliente tendrá la opción de cancelar el viaje o actividad contratada, sin penalización alguna, o aceptar las nuevas condiciones propuestas. El cliente deberá comunicar la decisión que adopte a Tracks and Pedals o, en su caso, a la Agencia Detallista, dentro de los tres días siguientes a ser notificado de la modificación. En el caso de que el viajero no notifique su decisión en los términos indicados, se entenderá que opta por la resolución del contrato sin penalización alguna.

Si durante el viaje o actividad, Tracks and Pedals no pudiera ofrecer alguno de los servicios contratados, se reembolsará el importe de dicha actividad o se tratará de encontrar un servicio de características similares. Si el cliente continúa con las soluciones dadas por Tracks and Pedals, se considerará que acepta tácitamente dichas propuestas.

En caso de que el cliente opte voluntariamente por la no realización de alguna actividad, Tracks and Pedals no deberá reembolsar cantidad alguna en ningún caso.

Las rutas descritas en los programas podrán realizarse en los sentidos expuestos en las fichas técnicas o en cualquier otro sentido.

En los casos que Tracks and Pedals condicione, y así lo especifique expresamente, la viabilidad de la oferta de viaje combinado a contar con un mínimo de participantes y por no alcanzarse ese número, se produzca la anulación del viaje o actividad, el usuario tendrá derecho exclusivamente al reembolso del total del precio o de las cantidades anticipadas, sin que pueda reclamar cantidad alguna por concepto de indemnización, siempre y cuando Tracks and Pedals o la agencia se lo haya notificado por escrito con un mínimo de 20 días de antelación a la fecha prevista de inicio del viaje combinado.

Las actividades de una o dos jornadas, están sujetas a las condiciones meteorológicas y a las características de las personas que participen. Los horarios, itinerarios y formas a seguir, podrán modificarse o incluso suspenderse en su totalidad o en parte, si las circunstancias lo requieren para preservar las condiciones mínimas de seguridad y siempre bajo el criterio de la empresa o de los guías, técnicos o monitores/as en nombre de Tracks and Pedals. En estos casos, no se procederá al reembolso de ningún importe abonado por el/la participante, dada la imprevisibilidad de estos factores (siempre y cuando la actividad ya hubiera comenzado). En caso de que aún no hubiera comenzado la actividad suspendida, sí que se devolverían los importes abonados por los/as participantes.

En cada actividad o viaje Tracks and Pedals especificará el tipo y cantidad de material necesario. Si a algún/a participante le faltara algún elemento imprescindible del equipo, los responsables de la actividad podrán suspender o retrasar el comienzo de la misma hasta que dicho problema sea subsanado o incluso optar por continuar con el programa sin la presencia de la persona afectada, si la falta de dichos elementos es imputable al/la participante.

17ª.- Exclusión/expulsión de las actividades.

Los/as guías, técnicos o monitores/as, en nombre de Tracks and Pedals, pueden excluir o expulsar de la actividad a cualquier participante, perdiendo cualquier derecho a reembolso del precio pagado, en alguna de las siguientes circunstancias:
No portar el equipo o material requerido, especialmente de protección y/o seguridad, cuando ello pueda derivar en algún riesgo para su propia salud o integridad física o la de terceros.
Padecer alguna enfermedad o lesión para la que no sea recomendable la realización de la actividad contratada.
Carecer del nivel físico o técnico necesario para realizar la actividad.
Estar bajo la influencia de sustancias alcohólicas, psicotrópicas, excitantes o alucinógenas, durante el desarrollo de la actividad.
No cumplir las instrucciones de seguridad y/o para el control del grupo que realice el/la técnico o guía.
Causar intencionada o imprudentemente daños al equipo o material prestado o alquilado.
Vulneración de normas legales, especialmente penales o administrativas.
Acciones reiteradas o graves de desprecio, burla o humillación hacia el resto de compañeros/as del grupo o de otras personas de fuera del grupo.
Acciones reiteradas o graves que, incumpliendo las instrucciones dadas por el/la técnico o guía, pongan en peligro la salud, integridad física o la vida, suya o de terceros.
En estos casos, Tracks and Pedals declina toda responsabilidad ante cualquier accidente producido por la imprudencia, negligencia o temeridad de cualquier participante.

18ª.- Suspensión de actividades.

Una vez iniciada cualquier actividad o viaje, Tracks and Pedals podrá suspenderlos, si no fuera viable la modificación del programa, en los siguientes casos:
Razones meteorológicas.
Razones de seguridad.
Órdenes de las autoridades administrativas.
Acuerdo del grupo.
En estos casos, Tracks and Pedals no reembolsará ninguna cantidad o indemnización a los/as participantes, ni se postergará la actividad a otra fecha.

19ª.- Protección de la propia imagen.

Toda persona que participe en las actividades de Tracks and Pedals tiene derecho a la protección de su imagen. En principio Tracks and Pedals entiende que el/la participante da su consentimiento a utilizar las imágenes que se tomen de él/ella en el transcurso de las actividades para campañas de información que Tracks and Pedals emprenda en el futuro y para mostrarla a otros participantes que realicen o puedan realizar viajes y/o actividades con esta empresa. No obstante, si expresamente el/la participante muestra su negativa a que se haga este uso del material audiovisual, Tracks and Pedals no difundirá o eliminará las imágenes o vídeos donde aparezca/n esta/s persona/s.

20ª.- Evaluación de las actividades.

Cualquier participante en las actividades y viajes de Tracks and Pedals está invitado a que aporte a la organización comentarios y opiniones constructivas, ya que con ellos se mejorará constantemente la calidad del servicio.

Por supuesto, en la oficina de Tracks and Pedals hay a disposición de cualquier usuario una hoja de reclamaciones.

21ª.- Aceptación.

El hecho de tomar parte en cualquiera de las actividades organizadas por Tracks and Pedals, supone la aceptación de estas condiciones por parte del/la participante.

2.- Risk management.

The activities offered by Tracks and Pedals imply an inherent and even deliberately sought risk, which the participant assumes and accepts. Taking this into account, it is not the responsibility of Tracks and Pedals to plan and carry out activities that are free from danger or “safe”, but to manage their risks in order to keep them within certain limits so that engaging in the activity does not entail damage to the physical integrity nor the life of the participants.

To that aim, Tracks and Pedals undertakes the following:
The technical staff will be qualified for the activity or trip to be carried out.
The activities and trips will be covered by public liability and accident insurances.
The activities and trips will be planned properly, especially with regard to risk and adversity management.

3.- Information about the activities.

In addition to providing information about the type of activity, the place where it will be carried out, the materials/equipment necessary and its duration, Tracks and Pedals also commits to specify, by means of scales or descriptions, the technical and physical difficulty of each activity. Tracks and Pedals may establish requirements or individual conditions of access to the activities or trips, only when this is considered necessary to preserve the minimal safety conditions of the activity or to guarantee its optimal performance and enjoyment for the participant and the rest of the group. The participant must find out all the relevant information about the activity to be done in order to make sure that said activity is indeed what they look for and that it is appropriate for their personal characteristics.

Regarding the necessary materials and equipment, the activity data sheet will indicate which materials and equipment will be supplied by Tracks and Pedals and included in the price, and which materials and equipment must be provided by the participant.

Tracks and Pedals reserves the right to modify the training offer featured on their website (modifications about activities, dates, schedules, locations, prices, offers and other commercial and service terms) at any time. Tracks and Pedals makes every possible effort to make sure that the information displayed on its website is accurate and has no typographical errors. In the event that, in spite of our efforts and totally involuntarily, such an error would ever appear in the information offered by Tracks and Pedals, we would proceed to amend it as soon as possible. Should there be a typographical error in any of the prices stated, and a customer would have taken a purchase decision based on such error, Tracks and Pedals will communicate the mistake to the customer and he/she will have the right to cancel their registration free of charge.

The contents provided on the website www.tracksandpedals.es may, in some cases, feature provisional information about some activities or trips. In the case that the information provided would not match the final characteristics of the training, the customer will have the right to cancel their registration free of charge.

4.- Minimum and maximum ratios for groups.

The activities or trips organised by Tracks and Pedals must count on the participation of a minimum number of people, which is determined by safety and/or economic profitability reasons.

Likewise, Tracks and Pedals also sets limits to the maximum number of participants per guide or technician and for each activity or trip, in order to guarantee the minimal safety conditions and an adequate use and enjoyment of the activity or trip in question by the whole group, which could not be guaranteed if the group would be excessively large.

5.- Psychological and physical condition.

The participant must inform Tracks and Pedals or, at least, the guides, technicians and instructors about:
Any health problems (allergies and illnesses).
Injuries.
Any treatment with medications that could impair their usual abilities.
Any incidence occurred during the journey to the activity (whether physical, mental, material, etc.), even if it could be deemed insignificant, such as dizziness caused by the journey or weakness caused by an insufficient breakfast, to put some examples.

The participants must undertake not to be under the influence of any alcoholic, psychotropic, stimulant or hallucinogenic substances in the dates in which the activities take place.

6.- Prices.

The prices are stated in euros and per person, and they include the services offered by the guides, technicians and instructors of Tracks and Pedals and the applicable VAT. Unless expressly indicated to be otherwise, the hiring of external services (hotels, mountain shelters, lodgings, meals, transportation, cable railway, etc.) will be borne by the participant.

7.- Registration in the activities.

The registration in the activities offered by Tracks and Pedals must be documented. The participant must fill out the registration form and send or submit it to Tracks and Pedals, mainly through their website www.tracksandpedals.es.

The registration shall not be deemed formal and effective until the price/booking of the contracted activity or trip has been paid, according to the procedure indicated in the following clause.

8.- Method of payment.

The 100% of the activity or trip must be paid to Tracks and Pedals before the 48 hours prior to its start, unless the specific conditions of the activity or trip indicate other payment terms. The 30% of the final price shall be paid in advance at the time of booking.

The payment of the activities or trips organised by Tracks and Pedals must be done using one of the following methods:
In cash, at the Tracks and Pedals office.
With credit or debit card.
By bank transfer or direct deposit to the following bank account number (Banco Santander):

If the payment is made through bank transfer or direct deposit, the participant must send by any means of communication or hand over the bank receipt of said deposit or transfer to Tracks and Pedals or, if applicable, to the guides, technicians or instructors before the start of the activity.

The payment must always be made in euros.

In certain cases, and in order to prevent possible fraud, Tracks and Pedals reserves the possibility to choose a specific method of payment, particularly in those cases where the identity of the holder of the means of payment is not duly verified.

9.- Cancellations.

When the customer decides to cancel an activity or trip, he/she must take into account that there are costs assumed by the agency in terms of payments to providers which, in most cases, may not be refundable, such as payment of certain accommodations, excursions or issuance of plane tickets. In these cases, said costs must be covered entirely by the traveller.

In case of withdrawal, the following percentages will be added to the total price of the trip, based on the moment in which it takes place and it is communicated to the agency:

a) Between 2 months and 15 days before departure: 5%

b) Between 14 and 3 days before departure: 10%

c) Within the 48 hours before departure: 25%

d) In case of no show of the customer at departure, in the time and place agreed, or without the necessary documents, the customer shall be obliged to pay the total cost of the trip or activity, settling, if applicable, any balance due.

The customer of a package travel may transfer their booking to a third person, by written request, at least 15 days before the start date of the trip, unless the parties agree on a shorter period in the contract. The transferee must satisfy the same requirements as the transferor which are required in general for the package travel, and both will be jointly and severally liable to the travel agency for the payment, the price of the trip and any additional costs arising from the transfer.

In those cases of a booking transfer where the plane ticket has already been issued and notified to the customer, the agency will be under no obligation to bear the costs derived from a change of the plane ticket passenger or a new purchase of flight services. The jointly and severally liable parties of the transfer shall be responsible for the issuance of new plane tickets.

Booking modifications: Any change and/or modification requested by the customers once the booking process has started (whether accepted or not) will incur administrative fees ranging from 30 to 55 euros, depending on the destination.

Tracks and Pedals has the right to cancel the trip or activity in cases of force majeure. It will be considered force majeure any kind of circumstance that is external to the control of the parties, extraordinary and unforeseeable, and whose consequences are totally unavoidable, in spite of having responded to it with due diligence.

The agency might cancel a trip due to force majeure cases, and the traveller will have the right to a refund of the amounts paid, except the administrative fees and those expenses which would have been notified as non-refundable (payment for certain accommodations, excursions or plane ticket issuance, among others).

The cancellation of an activity or trip will, under no circumstances, imply the refund of a sum greater than the cost of the activity or trip in question, and it will not obligate the organiser to offer a compensation.

If, due to force majeure causes, it were impossible to continue with the journey, the organiser shall assume the costs of the necessary accommodation, of an equivalent class whenever possible, for a period not greater than three nights per person. The traveller will have no right to receive any refund or compensation.

10.- Transportation.

Unless there is any indication to the contrary stated in the programme, the participant will be responsible for the costs and the arrangement of the transportation until the meeting point agreed with the Tracks and Pedals staff. The participant must arrive to the activity location with enough time in advance to solve any unexpected event or need. Likewise, the guides, technicians and instructors of Tracks and Pedals accept their duty to arrive on time according to the agreed schedules. The repeated incidence of small delays has a direct and very negative impact on the safety, the harmony within the group and the correct execution of the activity.

11.- Start of the activity.

The informative or explanatory session previous to the activity is considered the START of the services.

12.- Safety rules.

During the whole duration of the activity, the participant shall pay full attention to the instructions he/she may receive from the organisation, with special attention given to the guides, technicians and instructors in charge of the activity, following all the action and/or safety indications that they may provide.

Without the awareness and the express authorisation of the persons responsible, the participant will not position him/herself in potentially dangerous places such as steep slopes, precipices, unstable terrains, turbulent water currents, chasms, ice patches, icy areas, landslides, avalanches, etc.

13.- Use of the safety equipment or material.

The participant will make sure that he/she wears properly and at all times all the equipment specific to the activity, with special attention and care given to the protection and safety equipment, both individual and collective; he/she will preserve the materials assigned for the activities and will notify immediately in case of any damage or loss during the course of the activities. The equipments provided to carry out the activities are not items to play with, and making a proper use of them will guarantee that the activity is much more agreeable and safe.

Upon completion of the activity, the participant will return all the provided materials to the people in charge. In case of damage or loss of the materials borrowed or rented by Tracks and Pedals that is due to negligence by the participant, he/she might have to pay for its value or provide a replacement.

14.- Environmental rules.

The participant shall show deep respect for the natural environment in which the activity is carried out, having special care in protected natural areas, where, in addition, he/she shall comply with the regulations that apply to those protected areas. It is not allowed to leave any residues or waste in the natural environment. Moreover, the participant shall respect other groups or individuals that may be present in the areas where the activities take place.

15.- Duty of collaboration.

The activities are performed as part of a team, which means that the participant must collaborate with and help other participants and the people in change of the activity when necessary. The participant will not assume, under any circumstances, the duties or responsibilities of the guides, technicians or instructors, and will avoid arrogant or show-off behaviours, which usually end up deteriorating the atmosphere within the group.

16.- Modifications in the programme.

If, before the departure of a trip or the start of an activity, Tracks and Pedals would be forced to significantly modify any of the main aspects of the trip or activity, the customer will be notified about it at once, whether directly or via the retailer agency. In this case, the customer will have the option to cancel the trip or activity contracted without any penalty, or to accept the new conditions proposed. The customer must communicate their decision to Tracks and Pedals or, when applicable, to the retailer agency, within the three days following notification of the changes. If the traveller fails to communicate his/her decision within the period indicated, it will be understood that he/she has decided to terminate the contract without penalty.

If Tracks and Pedals would not be able to offer some of the contracted services during the trip or activity, we will refund the price of said activity or try to find a service of similar characteristics. If the customer continues participating in the solutions provided by Tracks and Pedals, we will consider that he/she implicitly accepts those proposals.

If the customer voluntarily chooses not to participate in any activity, Tracks and Pedals will in no case be under the obligation to refund any amounts paid.

The routes described in the programmes may be followed in the direction stated in the technical data sheets or in any other direction.

In those cases in which Tracks and Pedals expressly specifies that the viability of a package travel offer is subject to reaching a minimum number of participants and, due to failure to reach this number, the activity or trip needs to be cancelled, the user will be entitled only to a refund of the total price or the amounts paid in advance, and will not be entitled to claim any compensation, provided that Tracks and Pedals or the agency have notified them in writing at least 20 days before the expected start date of the package travel.

The activities consisting of one or two days are subject to weather conditions and the characteristics of the people participating in them. The schedules, itineraries and procedures to follow may be modified or even cancelled, in part or as a whole, if the circumstances so require it in order to maintain the minimum safety conditions. This will always be decided at the discretion of the company or of the guides, technicians and instructors acting on behalf of Tracks and Pedals. In those cases, there will be no refund of any amounts paid by the participant, since these factors are unforeseeable (provided that the activity had already started). If the activity had not yet started before cancellation, the amounts paid by the participants would be refunded.

For each activity or trip, Tracks and Pedals will specify the type and quantity of material required. If any participant is missing any essential piece of equipment, the people in charge of the activity may suspend or delay its start until the issue is solved or even choose to continue with the schedule without the affected individual, if the lack of these elements could be attributable to the participant.

17.- Exclusion/ban from the activities.

The guides, technicians or instructors, on behalf of Tracks and Pedals, may exclude or ban any participant from the activities, and the excluded participant will lose any right to a refund, if any of the following cases apply:

Not bringing the equipment or materials required, especially those related to protection and/or safety, when this might lead to any risks to their own health or physical integrity or that of third persons.

Having any illness or injury for which the contracted activity is not advisable.
Lack of the physical or technical level necessary to carry out the activity.
Being under the influence of alcoholic, psychotropic, stimulant or hallucinogenic substances during the course of the activity.
Failure to comply with the safety and/or group control instructions given by the technician or guide.
Causing damages to the borrowed or rented equipment or materials, whether deliberately or due to carelessness.
Infringement of legal regulations, especially criminal or administrative law offences.
Repeated or serious acts of disdain, mockery or humiliation towards the rest of team mates or other people.
Repeated or serious acts that, disobeying the instructions given by the technician or guide, pose a risk for the health, the physical integrity or the life of the participant or of third persons.

In these cases, Tracks and Pedals disclaims all responsibility for any accident caused by the imprudence, negligence or recklessness of a participant.

18.- Suspension of the activities.

Once any activity or trip has started, Tracks and Pedals may cancel them, if a modification of the programme would be unfeasible, due to the following causes:
Weather reasons.
Safety reasons.
An order from the administrative authorities.
By group agreement.

In these cases, Tracks and Pedals will not refund any amount or offer compensation to the participants, and the activity will not be postponed to another date.

19.- Image protection rights.

Every person who takes place in the activities offered by Tracks and Pedals has the right to the protection of their image. In principle, Tracks and Pedals assumes that the participants consent to the use of the images taken of them during the course of the activities in information campaigns that Tracks and Pedals may conduct in the future, and to show them to other participants that take or may take a trip and/or activity with the company. However, if a participant expressly objects to this use of their audiovisual material, Tracks and Pedals will not publish it or will delete the images and/or videos where this person appears.

20.- Evaluation of the activities.

Any participant in the activities and trips offered by Tracks and Pedals is encouraged to communicate to the organisation constructive feedback and comments, since they help us to constantly improve the quality of our services.

Of course, there is also a complaint form available for all users at the Tracks and Pedals office.

21.- Acceptance.

Taking part in any of the activities organised by Tracks and Pedals implies the acceptance of these terms by the participant.
